about Moldova Energy Project Implementation Unit,
financed by World Bank.
Regulation about Moldova Energy Project Implementation Unit, financed
by World Bank (further - Regulation), determines legal status, objectives,
functions and rights, as well as unit guidance.
I. General
-
Moldova Energy Project Implementation Unit, financed
by World Bank (further - Unit) is a non-profit, organization, obliged
to submit reports to Ministry of Finance and Ministry of Energy,
including reports about using of financial resources.

Location: Republic of Moldova, MD-2012 Chisinau,
31 August str., 82, office 2 (Government Regulation Nr.951 September
7, 2001) (NOTE:
At present the MEPIU offices are located at the following address:

block A1 , office 514)

The unit is administratively and financially
independent; possess the settlement and special accounts
in banks, including accounts in foreign currency, stamp
and headed note-papers.

Purpose of the Unit is to ensure effective implementation
of World Bank's energy projects by administration, monitoring and
co-ordination of works on their realization according to requirements
of international financial organizations.

The Unit, on basis of agreements with other international
organizations, can coordinate implementation activity of energy
sector projects, financed by these organizations or manage them.

The Unit implements its activity according to
current legislation of Republic of Moldova, this regulation, directions
and standards of World Bank and other international organizations
upon their request.
II. Major tasks of the Unit.

Major tasks of the Unit are:
- World bank's Energy Project implementation;
- Co-ordination of territorial subdivisions activities of the
Unit with the purpose of effective implementation and in order
to avoid doubling and parallelism of projects in energy sector;
- Correlation optimization among projects and simplification of
institutional connections among Government, managing structures
of the projects and World Bank;
- To provide assistance to World Bank supervisory missions and
further realization of recommendations in their reports;
- Evaluation and monitoring of project implementation and implementation
costs, providing of reports to Government and World Bank;
- Realization of disbursement of financial resources, destined
for projects and control for repayment of a credit by beneficiaries;
- Elaborating of budgets and estimates for projects, which are
in introduction stage;
- Compilation of quarterly, semiannual and annual reports about
project implementation process and utilization of means destined
for it, their submission to World Bank, Ministry of Finance and
Ministry of Energy;
- Maintenance of business accounting and submission of reports
of funds utilization for each project in introduction stage according
to World Bank requirements;
- Implementation or ensuring of implementation of all tasks, envisaged
in loan contracts for projects, including annual audit, monitoring
and evaluation of execution process, periodical control;
- Administration of special accounts of the Unit and ensuring
of utilization of project funds in strict correspondence with
their destination, established in project documents, preparation
of applications for account renewals, submission of reports about
funds utilization;
- Co-ordination and ensuring of effective training process implementation
of Unit's personnel, project beneficiaries, who are at introduction
stage or who are already introduced;
- Ensuring of carrying out of research, necessary for project
realization;
- Realization of other kinds of activity for effective project
introduction in energy sector.
III. Unit functions

According to major tasks Unit implements the
following functions:
Organization of tenders for purchasing of stock of materials at
the expense of World Bank credits and loans, selection of firm and
hiring of national and foreign firms, as well as selection of consultants
and conclusion of contracts with them ;
Rendering assistance to foreign partners and their experts in establishing
connections with economical agents and public machinery of government;
Realization of control and necessary verification of project components;
Supervision for activity of Unit's internal subdivisions;
Quality check and supervision on performance of services and works
and delivery of goods on term, established by firms and consultants,
with which Unit made a contract.
IV. Unit's rights

To perform its tasks and duties Unit has the
right to: possess, use its personal property and to manage it according
to major tasks of the Unit;
To develop its economical activity on basis of budget, structure
and kinds of activity, approved by Ministry of Finance, Ministry
of Energy in accordance with World Bank;
To make contracts with the Unit personnel, local and foreign consultants,
suppliers of goods and services to ensure effective introduction
of projects;
To manage Unit's current and special funds;
To check quality of works, services, goods, delivered by attracted
companies and consultants;
To sign reports of work completion, rendering of services and supply
of goods;
To approve reports of attracted companies, consultants and to pay
for completed works, services rendered and delivered goods.
V Unit's property
-
Unit's property consists of means acquired and
rendered according to current legislation.

Unit's financial resources consist of:
- Resources (including prepayment), provided by World bank and/or
other international financial organizations, envisaged for maintenance
of Unit activity;
- Subsidies, grants provided by local or foreign sponsors;
- Funds, provided by Government of Republic of Moldova.

Unit's funds should be reflected on bank accounts
in national and foreign currency and be used according to annual
budget, coordinated with World Bank and approved by Ministry of
Finance and Ministry of Energy.

Funds, which have not been used during current
year should be transferred to next year for utilization according
to budget, approved for current year.
VI. Unit management
-
Unit management staff are:
Supervisory board;
Chief executive.

Government must approve the stuff of Supervisory
board.

Supervisory board is responsible for: Conducting
of policy and common principles, which should regulate Unit activity;
Selection of candidature for the post of Chief Executive, as well
as his (her) appointment and dismission in accordance with World
Bank; Consideration and approval of quarterly and annual reports
about project implementation activity, as well as chief executive
reports.

Structure and numerical strength of executive
stuff have to be established in accordance with World Bank and supervisory
board and have to be approved by Ministry of Finance and Ministry
of Energy. The executive staff should include units for introduction
of each project and subdivisions, which provide services for all
projects (e.g., services for business and financial accounting,
funds transfer and procurements of services, works and goods, secretariat
services).

Unit's annual budget is elaborated by executive
personnel, should be co-ordinated with World Bank and Supervisory
board and be approved by Ministry of Finance and Ministry of Energy.

Unit's chief executive manages current activity
of executive personnel.

Project coordinators manage unit activity for
each project and submit to chief executive.

Unit chief executive, appointed in accordance
with World Bank and other donors, has to be a citizen of Republic
of Moldova, to have corresponding education and experience in World
Bank projects and to speak English.

Unit chief executive: Accounts for performance
of functions entrusted to Unit;
Organizes activity of personnel and unit consultants;
Represents the Unit in relations with state structures, international
organizations, project beneficiaries and others;
Hires and dismisses experts and other employees of Unit according
to structure of Unit executive direction, determine their official
duties and routine of work;
Signs treaties with firms-consultants and suppliers of goods;
Cancels allocation of funds in the form of technical assistance
in case of their utilization for purposes, which were not defined
in advance, and informs World Bank, Ministry of Finance, and Ministry
of Energy about it;
Submits reports to Supervisory Board;
Performs these functions both on the territory of Republic of Moldova
and abroad.
VII. Accounting
-
The Unit keeps accounting records and provides
statistical reports according to Moldova's legislation.

Ministry of Finance and World Bank supervise
financial activity of the Unit. Government of Republic of Moldova
should be informed about examination results.

Unit activity should be annually subjected to
external audit by auditor, selected on basis of tender and acknowledged
by World bank, Ministry of Finance and Ministry of Energy.
VIII. Cessation of Unit activity
-
Unit activity ceases on the ground of Government
resolution by reorganization or liquidation according to legislation
of Republic of Moldova.
SIDA-FINANCED
ENERGY SUPPORT PROGRAMME IN MOLDOVA
As
per the Specific
Agreement signed by the Government of Sweden and the
Government of Moldova on September 28, 2006, MEPIU is the implementing
agency for the Sida-financed Energy Programme in Moldova, which
closing date is June 30, 2010.
As per the
most recent update of the Procurement Plan, the Sida-financed
Energy Support Programme in Moldova has been grouped into the
following components, projects and packages:

SIDA
ENERGY EFFICIENCY PROJECT
NEWS - LATEST DEVELOPMENTS
In 2008-2009 the Government of Moldova continued
to examine together with SIDA the possibility of the Agency
to continue providing valuable support in the implementaiton
of different investment and technical assistance projects in
the Moldovan energy sector. The relevant project proposals have
been submitted to SIDA for consideration and eventual approval
of a new Programme in the energy sector to be launched in 2009.
Thus, on July 27, 2009 the Government
of Moldova and the Government of Sweden represented by SIDA
signed another Specific
Agreement referring to the Sida Energy Efficiency Project
in Moldova, namely the provision of a grant in amount of 16
million Swedish Kronor for financing the implementation following
projects in the Moldovan energy sector:
- Provision of Technical Assistance in
the implementation of the Extended Heating Component of Energy
II Project (Packages B8 and B9 - financed by the Word Bank
through the Additional Financing Agreement dated March 16,
2009);
- The Performance of a Feasibility Study
for the Reconstruction of the Heating, Ventilation, DHW, DCW
and Sanitation Systems at the Center for Mother and Child;
- The Installation of
a New Boiler Plant, Heating and DHW Substations, Reconstruction
of Distribution Pipes, Internal Heating and DHW systems at the
Children's Phthisiopulmonology (Tuberculosis) Center from Tirnova.
